Agreement

By accessing https://www.nepalharvest.com.au or placing an order with Nepal Harvest, you agree to these terms. If you do not agree, do not use the Site. Additional terms may apply to specific promotions or services — we will make those clear where relevant.

Australian consumer law

Nothing in these terms limits your rights under the Australian Consumer Law (ACL), including consumer guarantees that goods are of acceptable quality, match their description, and are fit for any disclosed purpose. Where our terms conflict with a non-excludable consumer guarantee, the ACL applies.

Orders, pricing & availability

• Product listings, images, and descriptions are provided in good faith. Weights, pack sizes, and ingredients may change — always check the label on delivery.
• Prices are in Australian dollars (AUD) unless stated otherwise and include GST where applicable.
• We may refuse or cancel an order where a product is unavailable, mispriced (including obvious errors), or where we suspect fraud or abuse. If we cancel after payment, we will refund amounts paid for the cancelled items.
• Stock levels shown on the Site aim to be current but are not a guarantee of availability at checkout.

Payment

Payment is processed by our third-party payment providers. You authorise us and our providers to charge your selected payment method for the order total and any applicable fees disclosed at checkout.

Delivery & pickup

Delivery dates, windows, fees, and areas are shown on our delivery calendar and described at checkout or elsewhere on our Site. Risk of loss or damage passes in line with our delivery terms stated at purchase. If you choose pickup, you are responsible for collecting within the agreed timeframe unless we agree otherwise.

Use of the Site

• You must not misuse the Site (for example, attempting unauthorised access, scraping in a way that harms performance, or introducing malware).
• You are responsible for keeping account credentials confidential and for activity under your account, except where we are at fault.

Intellectual property

Content on the Site (including branding, text, graphics, and layout) is owned by or licensed to Nepal Harvest. You may browse and print for personal use; reproduction for commercial purposes requires our prior written consent.

Liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from your use of the Site or purchase of goods, except where liability cannot be excluded under the ACL or other law. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or services or paying the cost of doing so.

Governing law

These terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of courts exercising jurisdiction in Australia.
